In these General Terms and Conditions "you" means the customer and "we", "us", "our" means Tbaytel

Essential Maintenance Plan

Includes: No labour charges for repair, backup battery replacement, annual system inspection, and defective security system component replacement.

Premium Maintenance Plan

Includes: No labour charges for repair, backup battery replacement, annual system inspection, defective security system component replacement, wireless battery replacement and 100% refund on one false dispatch charge incurred per year.

When subscribed to the above Essential or Premium Maintenance Plan, Tbaytel will make the necessary adjustments and repairs to keep the security system in good order. Coverage for qualifying systems will begin on the date the plan has been added to the service account and end when terminated by either the client or Tbaytel at any time, without notice. Included in the maintenance plan is labour for repair and maintenance, as well as defective component replacement as described herein, for one system per maintenance plan, valued at $1,500 or less. Defective component replacement will be honored until the component has exceeded 15 years of age. Components with an expiry date such as life safety – smoke, carbon monoxide detectors, etc. are not considered defective and not covered by this plan if they are near or past a manufacturer expiry date. Defective components required for the proper and normal functioning of the security system will be replaced without charge on an exchange basis. Replaced parts will become the property of Tbaytel (excluding batteries for wireless systems). The replacement type, make and size of such parts will be at the sole discretion of Tbaytel. This maintenance plan does not cover repairs or replacement parts due to renovations, requests to relocate equipment, loss or damage as a result of communication failure to the central station, loss or damage to the security system caused by wind, flood, fire, lightning, freezing, power failure, power reduction, unusual atmospheric conditions, water, tornado, hail, earthquake, explosion, smoke, aircraft, motor vehicle, animals, collapse of building, strike, riot or vandalism, acts of war or terrorism, corrosion or for any repairs or replacements caused or repaired by or resulting from the fault or negligence of the Client. Maintenance plans do not include troubleshooting or managing 3rd party applications for remote services, reprograming user codes or modifying automated schedules. It is the customer’s responsibility to contact Tbaytel to book an annual inspection appointment. Premium maintenance plan subscribers are eligible to receive a full refund on their first false dispatch occurrence per calendar year, when determined billable by the Thunder Bay Police. Subsequent false dispatches in a calendar year will be billed out at regular rates.

Attachments and Alterations

The Client is not to employ additional attachments, features or devices on the security system, make alterations to the security system nor participate in the maintenance of the security system without the written consent of Tbaytel, otherwise the maintenance plan and subsequent coverage will be terminated immediately.

Limitation of Liability

The liability of Tbaytel arising out of the maintenance service covered herein shall be limited to keeping the security system in good working order. Tbaytel shall not be liable to keep the system in working order when such failure is due to cases beyond its reasonable control, such acts of God, acts of civil or military authority, strikes, floods, epidemics, war, riots, delays in transportation and inability due to causes beyond its reasonable control to obtain necessary labour, materials or manufacturing facilities; nor shall its reasonable control to obtain necessary labour, materials or manufacturing facilities; nor shall Tbaytel, in any event be liable for consequential, indirect or special damages.

Coverage Area and Hours of Service

Tbaytel maintenance plans are available only to Tbaytel monitored customers who reside within the City of Thunder Bay and have qualifying security systems. All repair and maintenance work will be performed during regular business hours and based on available appointment times.

Client Obligation

The Client agrees to test the security system monthly according to test instructions provided by Tbaytel and notify Tbaytel of any malfunction from the result of a test.

Existing Security Systems

If Tbaytel has not previously been responsible for maintaining the security system, the said system is to be placed in acceptable working order before maintenance is provided hereunder, Tbaytel agrees to carry out an inspection of the said system for a nominal fee and to provide the client with an estimate indicating the expected cost of placing the security system in acceptable working order.

Payment

The cost for a maintenance plan is the advertised total monthly price shown and will be added to your monthly Tbaytel invoice. Prices are subject to change at any time.
